1. Agreement
These Terms of Service (“Terms”) are a legally binding agreement governing your use of games and applications offered by MAD Studios, s.r.o. (“MAD”) and accessed through third-party websites or platforms (collectively, the “Service”). By using or accessing the Service, you agree to be bound by these Terms.
2. Access to the MAD Service
- Subject to your acceptance of these Terms, MAD grants you a non-exclusive, non-transferable and revocable limited licence to use and display the Service and related software, excluding source and object code, for your personal or household non-commercial use on devices of which you are the primary user.
- You may not use the Service for another purpose or copy or distribute its content except as expressly allowed in these Terms.
- MAD may change these Terms. An amendment will not apply to a dispute of which MAD had actual notice on the date of the amendment. Modifications may be posted within MAD applications, and you agree to check the Terms periodically.
- MAD may discontinue the Service or change its content at any time, with or without notice and without liability.
- You agree to follow any application- or game-specific rules published within the Service.
- Your use of the Service depends on compliance with these Terms. Use in violation of these Terms may infringe MAD copyrights, and MAD may terminate access without notice.
- You represent that you are at least 13 years old. If you are between 13 and 18, you represent that your legal guardian has reviewed and agreed to these Terms.
3. Ownership of intellectual property
Unless otherwise stated in writing, materials that form part of the Service are owned, controlled or licensed by MAD and are protected against unauthorised use. The Service contents are protected under Slovak copyright law and similar laws in other jurisdictions. MAD, MAD logos and game names are trademarks of MAD and may not be used without express written permission.
You do not acquire ownership rights by using the Service, downloading material, uploading material or purchasing virtual goods. You may not copy, redistribute, publish or otherwise exploit Service material except as expressly permitted in writing.
Comments, feedback, suggestions and ideas submitted to MAD in connection with the Service may be used and disclosed by MAD without restriction or compensation, except where prohibited by law.
4. In-game currencies and goods
The Service may include virtual currency such as coins, cash or points, and virtual digital goods. Where offered, adults may be able to purchase these items with real-world money.
- Virtual Currency and Virtual Goods cannot be redeemed for real-world money, goods or other items of monetary value from MAD or another party.
- You receive only a limited, personal, revocable, non-transferable and non-sublicensable licence to use Virtual Currency or Virtual Goods in the Service. You have no ownership right or title in them.
- MAD may manage, regulate, control, modify or eliminate Virtual Currency or Virtual Goods and will have no liability for exercising these rights.
- Transfers are prohibited unless MAD expressly authorises them. You may not buy, sell or exchange them outside the Service for real money or other value.
- Sales are final and refunds are not provided except at MAD’s discretion or where applicable law requires otherwise. Virtual items are forfeited if an account is terminated or suspended, or if MAD discontinues the Service.
5. User content
The Service may allow users to submit or publish text, images, comments, suggestions or other materials (“User Content”). Material transmitted to MAD is treated as non-confidential and non-proprietary.
You represent that your User Content is original to you and that you own the rights necessary to grant the rights described in these Terms without creating third-party obligations or liability for MAD.
You grant MAD an unrestricted, worldwide, irrevocable, perpetual, fully paid and royalty-free right and licence to host, use, reproduce, distribute, display, perform, transmit, publish, modify, translate, archive and otherwise exploit User Content in any format or medium, including in connection with promotion of the Service, to the extent permitted by law.
MAD has no obligation to accept, display, monitor or maintain User Content. MAD may remove, move, reformat, edit or refuse User Content without notice where permitted. You acknowledge that MAD is not required to monitor or edit the Service and that some content may be objectionable.
6. Usage rules
As a condition of using the Service, you agree to comply with these Terms and applicable game-specific rules. Your activity and User Content must be lawful and must not:
- include discriminatory, obscene, indecent, defamatory, threatening, harassing, intimidating or abusive content;
- promote violence or describe how to commit a violent act;
- violate contractual, privacy, intellectual-property or other rights, or promote illegal activity;
- reveal another person’s personal or financial information, or be used to track, contact or impersonate another person;
- mislead users or MAD, improperly use support services, submit false reports, or attempt to obtain sensitive account information;
- conduct unauthorised commercial promotion, fundraising, advertising or multi-level marketing;
- disseminate viruses, malware, spyware, adware or other malicious or invasive code;
- spam or otherwise interfere with the operation, features or enjoyment of the Service;
- copy, adapt, reverse engineer, decompile, modify or attempt to discover Service software or code except where applicable law expressly allows it;
- use unauthorised automated systems, bots, cheat utilities, scrapers, scripts or offline readers to access the Service;
- cover notices, disguise the source of information, circumvent access restrictions or security features, or anonymise an address to evade restrictions;
- sell the Service, accounts, access, Virtual Goods or Virtual Currency for real money or other value; or
- engage in cheating or activity that MAD considers contrary to the spirit or intent of the Service.
MAD does not control or endorse content or information found in user-content areas or on external sites linked to or from the Service and disclaims responsibility for that content to the extent permitted by law.
7. Privacy and personal information
MAD respects the privacy of players. Information collected through a social network or platform may also be subject to that network’s or platform’s policy. Please review the MAD Privacy Policy, which is incorporated into these Terms.
If you do not agree to the Privacy Policy, do not use the Service or submit personally identifiable information. Privacy questions may be sent to Email address protected.
8. Disclaimers and limits of liability
To the fullest extent permitted by applicable law, you use the Service at your sole risk and the Service is provided “as is”, without warranties of any kind, express or implied, including warranties of title, non-infringement, merchantability or fitness for a particular purpose. Any legally required warranty period is limited to the minimum period required by law.
MAD and its related parties do not warrant that the Service will be uninterrupted or error-free. To the fullest extent permitted by law, they are not liable for direct, indirect, incidental, special, exemplary or consequential damages arising from use of or inability to use the Service, regardless of the cause of action.
You acknowledge that MAD is not responsible for the conduct of third parties, including other users and operators of external sites. To the extent permitted by law, MAD’s total liability will not exceed the amount you paid MAD during the 90 days immediately before first asserting the claim.
9. Indemnification
You agree to defend, indemnify and hold harmless MAD and its related parties from claims and expenses, including reasonable legal fees and costs, arising out of your use of the Service or your breach or alleged breach of these Terms. This section survives termination of an account or the Service, to the extent permitted by applicable law.
10. Governing law and disputes
These Terms and all aspects of the Service are governed by the laws of Slovakia, regardless of your location, subject to any mandatory protections that apply in your jurisdiction.
For disputes not subject to another mandatory process, the parties agree to first attempt informal resolution for at least 30 days after written notice. Legal or dispute-related notices may be sent to Email address protected, addressed to MAD Studios, s.r.o., Slovakia, European Union.
The source terms contain a legacy postal address for legal notices. It has intentionally not been published here. The appropriate legal notice method and the effective date of these Terms require confirmation by MAD Studios before publication.
